1. Scope
1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the supply of goods concluded by consumers with Aurya-Wallart (hereinafter “Seller”) via the Seller’s online shop.
1.2 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional (§ 13 BGB).
1.3 Deviating terms and conditions of the customer do not apply unless the Seller expressly agrees to their validity in writing.

The Seller is a small business within the meaning of § 19 (1) of the German VAT Act (UStG).
No VAT is charged and therefore not shown.
3. Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an order.
3.2 The customer can initially place the products in the shopping cart without obligation and can correct their entries at any time before submitting the binding order by using the correction options provided in the ordering process.
3.3 By clicking the “Buy now with obligation to pay” button, the customer submits a binding offer to conclude a purchase contract.
3.4 The contract is concluded when the Seller accepts the customer’s offer by sending an order confirmation by email or by dispatching the goods.
3.5 The contract text is stored by the Seller. The order data and these GTC will be sent to the customer by email after the contract is concluded. No further access to the contract text will be provided.
3.6 The language of the contract is German.
4. Prices and Shipping Costs
4.1 All prices stated are final prices. Due to the small business regulation according to § 19 (1) UStG, no VAT is charged and not shown.
4.2 In addition to the stated prices, shipping costs will apply. The amount of shipping costs will be clearly communicated to the customer during checkout before completing the order.
4.3 Shipping costs may vary depending on the shipping method and delivery country (e.g., standard shipping within Germany from €6.90, express shipping within the EU up to €49.90).
4.4 There is no minimum order value.
5. Payment Terms
5.1 Payment is due immediately upon conclusion of the contract.
5.2 The following payment methods are available:

5.3 If the payment fails for technical reasons, the Seller’s claim to payment remains valid.
6. Delivery and Shipping
6.1 Delivery is made to the delivery address provided by the customer.
6.2 Shipping is only available within the European Union (EU).
6.3 Estimated delivery times:

Standard shipping: approx. 3–10 business days

Express shipping: approx. 1–4 business days
6.4 The applicable delivery time depends on the shipping method chosen at checkout.
6.5 The risk of accidental loss or accidental deterioration of the goods transfers to the consumer only upon delivery of the goods.
7. Retention of Title
The goods remain the property of the Seller until full payment of the purchase price has been made.
8. Right of Withdrawal for Consumers

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
Withdrawal Period
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g., by email or letter) of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not obligatory.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we are informed of your decision to withdraw from this contract.
For this reimbursement, we use the same payment method as you used for the original transaction unless expressly agreed otherwise with you.
We may withhold reimbursement until we have received the goods back or you have provided evidence that you have returned the goods, whichever is earlier.
Return of Goods
You must return the goods immediately and in any event no later than fourteen days from the day on which you inform us of the withdrawal.
You bear the direct cost of returning the goods.
Compensation for Diminished Value
You are only liable for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.

10. Warranty
The statutory warranty rights apply.
The warranty period is two years from delivery of the goods.
11. Liability
11.1 The Seller is fully liable in cases of:

Injury to life, body, or health

Intent or gross negligence

Claims under the Product Liability Act
11.2 For slightly negligent breaches of essential contractual obligations (cardinal obligations), the Seller is only liable for the typical, foreseeable damage.
11.3 Any further liability of the Seller is excluded.
12. Dispute Resolution
The Seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
13. Copyright
All designs, motifs, and graphics are protected by the Seller’s copyright.
The purchase of a physical product does not confer any right to reproduce, modify, digitize, or otherwise commercially use the motifs.
The resale of the purchased physical product as a single item is permitted (§ 17 (2) UrhG).
14. Final Provisions
14.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
14.2 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
